CloudPouch End-User License Agreement
Last updated: 31 October 2026
Please read this End-User License Agreement (the "Agreement") before you install or use CloudPouch. A copy is available as a PDF at cloudpouch.dev/eula.pdf.
1. Who we are and what this Agreement covers
This Agreement is between you and Paweł Zubkiewicz, trading as Paweł Zubkiewicz Consulting, ul. Marca Polo 39/9, 51-504 Wrocław, Poland, tax ID (NIP) 8981957769 ("we", "us"). It covers the CloudPouch desktop application for macOS, Windows and Linux, its updates and the licensing service it uses, on every plan.
2. Definitions
- Application: the CloudPouch desktop application and its updates.
- Plan: Free, Pro trial, Pro or Team, as described on cloudpouch.dev/#pricing.
- License Key: the key that the Licensing Service issues to you.
- Licensing Service: our online service that registers users, issues License Keys and confirms the Plan of each License Key.
- Your AWS Account: any Amazon Web Services account that the Application accesses with the credentials on your computer.
- AI Assistant: an AI tool of your choice, such as Claude Code, Codex or Cursor, that you connect to the MCP server built into the Application.
- Third-Party Services: services, software and content provided by others, such as Amazon Web Services, GitHub, Paddle and AI Assistants.
- You: the person who uses the Application, or the company or other organisation on whose behalf that person uses it.
3. Accepting this Agreement
You accept this Agreement when you tick the box agreeing to it during registration, or when you install or use the Application, whichever happens first. If you accept it on behalf of an organisation, you confirm that you have the authority to bind that organisation. Without your agreement, you may not install or use the Application.
4. License
We grant you a limited, non-exclusive, non-transferable and revocable license to install and use the Application for your personal and business purposes, within your Plan and this Agreement. The Application is licensed, not sold.
Each license, including each Team seat, is for one person, who may use it on up to three computers.
5. Plans, trial and registration
- Free is our basic plan and has no end date. It includes the features listed for Free on the pricing page.
- The Pro trial gives you the Pro features for 7 days from registration, with no payment card. When it ends, the Application switches to Free the next time you start it.
- Pro is a paid subscription, billed monthly or yearly through Paddle (see section 6).
- Team gives Pro to each seat, with a minimum of 3 seats. It is offered by email at hello@cloudpouch.dev, and we issue its License Keys ourselves.
- Licenses for earlier versions: a paid license bought for an earlier version of CloudPouch keeps working as Pro.
Current features and prices are on the pricing page. To register for Free or the Pro trial, you give your email address, accept this Agreement and enter the 6-digit code we email you; the License Key then appears in the Application, and a copy is sent by email. Keep your License Key private and do not share it with other people.
Each time it starts, the Application checks your License Key with the Licensing Service and runs the Plan that the service confirms. This check needs an internet connection: the Application has no offline mode.
6. Payments, renewals and refunds
Pro licenses are sold by Paddle.com as merchant of record (reseller). Paddle processes the payment and issues the invoice, and depending on the laws of your country, tax may be added to the price. The purchase is also governed by Paddle's Buyer Terms at paddle.com/legal/buyer-terms.
A subscription renews at the end of each billing period until you cancel it. To cancel, open the link "review your subscription" in the email from Paddle and choose Cancel Subscription. Pro stays active until the date on which Paddle ends the subscription; after that date, or if a payment fails, the license moves to Free.
Paddle handles refunds under its Refund Policy at paddle.com/legal/refund-policy. If you are a consumer, you also keep any right to withdraw from the purchase that the law of your country gives you.
7. Restrictions
You must not:
- sell, rent, lend or sublicense the Application or a License Key;
- let more people use a license than it covers, for example by sharing your License Key;
- work around the license check or the limits of your Plan;
- decompile, reverse engineer or modify the Application, except where the law allows this despite this restriction;
- break the law, or the terms of Amazon Web Services or any other Third-Party Service, with the help of the Application;
- remove notices of ownership from the Application.
8. Ownership
We and our licensors own the Application and all intellectual property rights in it. Open-source components included in the Application are licensed under their own licenses. Your data remains yours: the cost data, scan results and settings that the Application keeps on your computer belong to you, and this Agreement gives us no rights to them.
9. Your AWS account
The Application reads data from Your AWS Account with the credentials on your computer and does not change your AWS resources. Responsibility for those credentials, the permissions you give them and your use of AWS under your agreement with Amazon Web Services rests with you. AWS charges some of the requests that the Application makes, such as Cost Explorer API requests, to Your AWS Account; the Application keeps fetched data on your computer to reduce them.
10. Savings recommendations and AI assistants
Savings Scan results, Cost Insights, savings estimates and recommendations are information to help you decide. They are based on the data available to the Application at the time and can be incomplete or wrong. None of them is a promise of any saving or professional advice.
Whether to change anything in Your AWS Account is your decision, and you are responsible for every change you make, including changes made by people or tools acting for you. Before making a change, check its effect, for example on availability, performance, backups and security.
The MCP server of the Application is off by default. Once you turn it on, the AI Assistant you connect can read the data that the Application holds and ask it to refresh cost data or run a Savings Scan; AWS bills a forced refresh like any other Cost Explorer request. The AI Assistant is a Third-Party Service under its own terms. We are not responsible for its answers or actions, or for what it does with the data it reads.
11. Updates
When the Application opens its window, it checks GitHub Releases for a newer version; updates are downloaded from there. Updates may add, change or remove features. This Agreement applies to each update unless the update comes with a new version of this Agreement.
12. Privacy
Our Privacy policy at cloudpouch.dev/privacy/ describes the personal data we process, including the data sent for registration, the license check and error reports, and your rights.
13. Third-Party Services
The Application works with Third-Party Services and may link to them. We are not responsible for Third-Party Services, including their accuracy, availability, legality or quality. Your use of them is at your own risk and subject to their own terms.
14. Term and termination
This Agreement applies from the moment you accept it until it ends. To end it yourself, delete the Application and all its copies from your devices. We may suspend or end this Agreement at any time, with or without notice. It also ends automatically, without notice, if you fail to comply with any of its terms.
When this Agreement ends, stop using the Application and delete all its copies. Ending it does not limit our rights or remedies for any breach that happened before.
15. Indemnification
You agree to indemnify us and our affiliates, employees, agents, partners and licensors against any claim or demand, including reasonable legal fees, arising from your use of the Application, your breach of this Agreement or of any law, or your violation of the rights of a third party.
16. No warranty
The Application is provided "as is" and "as available", with all faults and without warranty of any kind. To the maximum extent permitted by law, we disclaim all warranties, whether express, implied or statutory, including warranties of merchantability, fitness for a particular purpose, title and non-infringement.
In particular, we do not warrant that the Application will meet your requirements, reach any savings or other result, work with other software or systems, run without interruption or errors, or that its information is accurate, complete or current. Some jurisdictions do not allow these exclusions; there, they apply to the greatest extent the law allows.
17. Limitation of liability
Our total liability under this Agreement is limited to the amount you actually paid for the Application, or 100 USD if you paid nothing.
To the maximum extent permitted by law, we are not liable for any special, incidental, indirect or consequential damages, including loss of profits, expected savings, data or business, business interruption, costs charged by AWS, or the results of changes made in Your AWS Account, even if we were told that such damages were possible.
Nothing in this Agreement limits liability that cannot be limited by law, such as liability for damage caused intentionally. Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, so the limitations above may not apply to you.
18. Consumers
If you use the Application as a consumer, the mandatory consumer protection laws of your country of residence also apply, and nothing in this Agreement limits the rights they give you.
19. Export and sanctions
You confirm that you are not located in a country subject to a United States government embargo or designated by the United States government as a "terrorist supporting" country, and that you are not on any United States government list of prohibited or restricted parties.
20. Severability and waiver
If a provision of this Agreement is held unenforceable or invalid, it will be changed and interpreted to achieve its purpose as far as the law allows, and the other provisions remain in full force. A failure to exercise a right or to require performance under this Agreement does not waive that right, and the waiver of a breach does not waive any later breach.
21. Changes to this Agreement
We may change or replace this Agreement at any time. For a material change, we will give at least 30 days' notice before the new terms take effect; whether a change is material is our decision. By continuing to use the Application after the new terms take effect, you agree to them. If you do not agree, stop using the Application.
22. Governing law and disputes
This Agreement and your use of the Application are governed by the laws of Poland, excluding its conflict of laws rules. A dispute with a customer who uses the Application for their business, trade or profession will be settled by the common court that has jurisdiction over our place of business in Wrocław, Poland. If you are a consumer, a dispute goes to the court that has jurisdiction under the law that applies to you, and section 18 applies. Your use of the Application may also be subject to other local, national or international laws.
23. Entire agreement
This Agreement is the entire agreement between you and us about the Application and replaces all earlier written or oral agreements on this subject. Additional terms may apply when you buy or use other services, such as Paddle's terms for a purchase.
